UPDATE: Charlie Sheen Arrest Sparked by Divorce Talk

Charlie Sheen is out of jail - but headed to divorce court, it was reported Saturday.

The actor and wife Brooke Mueller, married since May 2008, recently took a quiet trial separation, Radaronline.com reported.

They got together in Aspen - where Mueller rented a house - for the holidays and started arguing early Christmas morning, the gossip site said.

It got heated, and cops were called. Sheen, 44, was hauled off to jail and charged with assault and other crimes.

The "Two and a Half Men" star was released Christmas evening after posting $8,500 bond.

Now Mueller, who has infant twins with Sheen, plans to file for divorce "in the very near future," the gossip Web site reported.

"Both of them are miserable in the marriage. That's why they were apart," a source who knows the couple told the site.

"Both were separately telling friends their marriage was over before this happened."

TMZ reported that Mueller initially claimed Sheen attacked her and then changed her story before his bail hearing, saying she was drunk at the time.

The site says she has stopped cooperating with Aspen cops, who tried to re-interview her on Saturday.

After his client's arrest, Sheen's publicist released a statement saying, "It would benefit everyone not to jump to any conclusions."

Sheen is due back in court Feb. 8.
