Shaniya Davis UPDATE: Mother Released in Lieu of $51K Bond

Antoinette Davis, the mother of little Shaniya Davis has been released from Central Women’s Prison in Raleigh, North Carolina.

The Black Urban Times spoke with a legal assistant at the office of her attorney, D.W. Bray and was told that Davis is still facing the original charges she was hit with when she was arrested last year: filing a false police report, resisting a public official (both misdemeanors), child abuse for the purpose of prostitution and human trafficking a child victim, both felonies.

Sergeant Somerindyke at the Fayetteville Police Department told the Black Urban Times that Davis had been released on February 21 in lieu of a $51,000 bond and Cumberland County court official, Jennifer S. confirmed for the Black Urban Times that Davis’ next court date is scheduled for April 15.

Mario Andrette McNeill, 29, who was identified as the man seen carrying Shaniya Davis on a Comfort Suites Hotel security video in Sanford has been charged with first-degree kidnapping, first-degree rape and first-degree murder. He is still being held at the Central Prison in Raleigh.


Shaniya’s lifeless body was found on November 16, six days after her mother reported her missing. A subsequent autopsy ruled Shaniya’s cause of death as asphyxiation. The little girl, who was described by neighbors and relatives as a happy and loving child, had also been raped.

Police recovered Shaniya’s body after a tip from a “credible source” led them to a deserted area off of Highway 7 along Walker Road in Lee County.

Davis had been caring for Shaniya for approximately three weeks when she disappeared. Shaniya’s father, Bradley Lockhart, had allowed his daughter to return to Davis saying he wanted to give Davis a chance to be a mother again after a lengthy separation.


Lockhart, who works as a contractor, was out of the state working at the time his daughter disappeared from her mother’s Sleepy Hollow Drive mobile home in Fayetteville. He has since stated that he regrets his decision to return Shaniya to her mother although it appeared that Davis was getting her life together.

Police have theorized that Davis may have sold her daughter into sexual slavery to repay a drug debt she owed to McNeil. Initially, Davis accused Clarence Coe, a man described as Antoinette Davis' former boyfriend and the father of her unborn child, of taking Shaniya. He was arrested, but immediately released after security footage showed McNeil carrying Shaniya.

Coe told WRAL, “ I didn’t get due process. They didn’t even have probably cause to cause [sic] to arrest me.” He said he plans to sue the Fayetteville police.

Several of Davis’ family members have said they do not believe Davis would harm any of her children nor do they believe she had anything to do with Shaniya’s murder.

Brenda Davis, 20, sister of Antoinette Davis said she does not believe the accusations police have made against her sister. “I don’t believe she could hurt her children,” said Brenda Davis.

Antoinette Davis’ aunt, Yvonne Mitchell added that Davis had two jobs and would never harm Shaniya.

McNeil’s girlfriend, April Autry told reporters that she had never noticed any signs of abuse on the daughter she and McNeil share together and that she was shocked at the charges police have hit McNeil with.

With 1500 people in attendance at Shaniya’s funeral, which was paid for by NBA star Shaquille O’Neil, Shaniya’s father bid a tearful goodbye to his daughter.

“Shaniya, Daddy love you, honey [sic]. And I know you’re gonna’ be waiting for me…I’ll see you when I get there.” Surrounded by family and friends, Lockhart stood at Shaniya’s grave site and released white doves into the winter air in memory of his baby girl.

Shaniya Davis was five-years-old.

Shaquille O'Neal Pays for Shaniya Davis' Funeral

Touched by the circumstances and death of 5-year old Shaniya Davis, NBA star Shaquille O'Neal paid for the all of the funeral arrangements.

O'Neal, a father of five, did not disclose how much he paid for the services which were held Sunday at the Manna Church in Fayetteville, but did release this statement, "What happened to [Shaniya] was tragic. I wanted her to have a funeral that would be as beautiful as she was," O'Neal
said. A Cavaliers official did not return calls from The Associated Press early Thursday and The funeral home declined comment.

Bradley Lockhart said that the money Shaq had given has been put into a trust fund to pay for the girl's funeral and that the remaining money will be donated to a charitable cause.

CHILD FATALITY TASK FORCE TO INVESTIGATE FAYETTEVILLE DSS
On Monday, the North Carolina Child Fatality Task Force announced that it will review the Cumberland County Department of Social Services records to see what type of contact they may have had with Antoinette Davis and how often. Cumberland County DSS has declined to say what kind of involvement the agency had with Davis and her children.

11 Years ago, Bradley Lockhart Lost Wife to Tragic Murder

11 years ago, in March 1998, Bradley Lockhart, the father of 5-year-old Shaniya Davis, experienced an unimaginable tragedy that left two people wounded and three dead including his wife of seven years, Vickie Sue Lockhart, then 28, his wife’s 19-year-old sister, Channel Coleman and another man, 24-year-old David Lee Epps.

Today, he is preparing to bury another family member -- his five-year-old daughter, Shaniya Davis. Davis was the recent focus of a massive search that griped a nation and ended with North Carolina officials finding her body along side a road in Sanford, North Carolina.



In all, five people were bound, gagged and shot that evening on March 3, 1998. The murders occurred at a duplex apartment on Graham Road in Fayetteville that was being rented by Joe Epps Staton the brother of David Epps.

The two injured men were Thorsten Malin, 21, and Tyrone Parker, 20. Malin rented the home along with Staton who was not home at the time of the murders.
Police reports stated that two men broke into the home with the intent to rob Joe Epps who had received almost $20,000 in a settlement the year before.” They thought it was in the house,” said mother Sheila Epps.“The money was in the bank, but my son may have bragged about having it.”

Police reports stated that the killers walked into the home around 1 a.m. after one of them identified himself at the door. Each person in the home was bound, gagged and then shot several times.

The Sheriff Department was summoned to the home at about 1:24 a.m. after Malin freed himself and escaped through a bedroom window and went to the duplex apartment next door, where the landlord lived, and they called 911.

The killers left the home after the murders, tossing the murder weapon near a school bus stop on the corner of Mackenzie and Duncan Streets in the Spring Lake area of Fayetteville.
Four men were arrested for the shotgun killings, but only two were convicted for the triple homicide, Vincent Lee Thomas and Litdel Burkhalter. Both were charged with First-Degree murder,
First-Degree Kidnapping, Robbery with a Dangerous Weapon, Conspiracy to Commit Armed Robbery and Assault with a Dangerous Weapon with the intent to kill.

Both were sentenced to life in prison.
Bradley and Vickie Sue Lockhart, had three children together.

Since the murder of his wife, Bradley Lockhart's children have mostly stayed with their grandparents in the Remington subdivision behind Seventy-First High School.

Thomas was a soldier stationed at Fort Bragg at the time of the murders.

He voluntarily went to the Cumberland County Sheriff’s Department after eyewitnesses fingered him in a photo line-up. He was arrested at that time.


Since Thomas’ conviction, he has had 27 infractions while in prison, the latest having occurred in February 2009 according to the North Carolina Department of Corrections. He is currently incarcerated at the high security State Prison Scotland in Laurinburg, North Carolina.

Burkhalter, who is now 33-years-old, was arrested the day after Thomas and led Deputies to the area where the shotgun had been disposed of. It wasn’t there. Police warn of scam involving Shaniya Davis case

Fayetteville police are warning residents about a scam involving subjects soliciting money in the name of Shaniya Davis.

Police said a man in the area of McPherson Church and Skibo roads was holding a sign indicating he was collecting money for Shaniya from passing motorists.

"It's just a play on people's sympathy," said Sgt. John Somerindyke. "There's a lot of interest in the case. These scam artists know that and are going to try and take advantage of it."

Shaniya's body was found Monday in Lee County, about six days after she was reported missing from her mother's home in Cumberland County.

The case, which involved several local and federal law enforcement agencies, has received national attention.

Shaniya's mother, Antoinette Davis, and a Fayetteville man have been charged in her disappearance.

Antoinette Davis faces charges that include child abuse involving prostitution. Mario Andrette McNeill, 29, is charged with first-degree kidnapping. Police say he was seen carrying Shaniya into a Sanford hotel after she went missing.

Other charges in the case are pending until authorities decide which law enforcement agency has jurisdiction.

Somerindyke said motorists reported the man soliciting money about 11 a.m. and said undercover officers are trying to locate him.

The man is wearing a gray sweatshirt and dark hat.

The man, who stutters, told one passerby that he was collecting money for the Fayetteville Police Department, according to a release.

Police said no member or representative of the department is collecting money on behalf of Shaniya.

"Before donating money to any cause, one should make efforts to verify the authenticity of the organization," officials said in a news release.

Somerindyke said it was rare for criminals to so blatantly try to take advantage of a crime or victim, but said he wouldn't be surprised if similar scams are reported to police.

Anyone who knows the identity of the man or sees similar activity is asked to call Fayetteville police at 433-1585 or Crimestoppers at 483-TIPS.

Shaniya's Family Speaks

(CNN) -- A body found Monday beside a North Carolina road is that of 5-year-old Shaniya Davis, who was reported missing a week ago, police said Tuesday.

The official cause of death was undetermined as of Tuesday afternoon, Fayetteville police said in written statement. An announced afternoon media briefing was rescheduled for Wednesday morning.

Earlier Tuesday, police said additional charges are expected in connection with the case and any charges will be made public as soon as they are filed.

Shaniya's mother, Antoinette Nicole Davis, has been charged with human trafficking and other offenses. Davis was "prostituting her child," police spokeswoman Teresa Chance said after Davis' arrest over the weekend.

Another suspect, Mario Andrette McNeill, has been charged with kidnapping in the case.

Shaniya's father, Bradley Lockhart, made a tearful appeal before reporters Tuesday afternoon, asking that "everybody makes it a point not to ignore, to look past a situation where a person, a child, or anybody might be in danger ... so that we don't have another tragedy like Shaniya."

He said authorities have given him limited information, but he was to meet with them later.

"It's not the result I wanted, it's not the result any father or family would want for their children," he said. "But God has a greater calling for all of us."

Shaniya's mother reported her missing from their Fayetteville home in a mobile home park on November 10. According to police, surveillance video taken that day from a hotel in Sanford shows Shaniya in the company of McNeill.

"The investigation at this point indicates that Shaniya Davis was alive at the time she left the Sanford hotel," police said in the statement Tuesday.

The road where the body was found is near Sanford, which is about 30 miles northwest of Fayetteville.

Shaniya's half-sister, Cheyenne Lockhart, said on HLN's "Nancy Grace" Monday that she found it difficult to believe Davis had treated her daughter so poorly.

"She seemed like the sweetest woman. She didn't come from much, but ... she had the sweetest voice, she had the sweetest personality, and especially toward me. I would never think that she would do anything like that," said Lockhart, who shared a father with Shaniya.

Their father said Shaniya went to her mother's home on October 9.






Additional Charges Forthcoming in Shaniya Davis Case

Police say additional charges are expected in connection with the death of five-year-old Shaniya Davis who was reported missing by her mother one week ago.

Those additional charges will be made public as soon as they are filed police said. Another media briefing is scheduled for Tuesday afternoon.

Shaniya's mother, Antoinette Nicole Davis, has been charged with human trafficking amongst other crimes along with Mario McNeil, the man seen on video footage from a local hotel carrying Shaniya. Police have accused Shaniya's mother of "prostituting her child," police spokeswoman Teresa Chance told the Associated Press.

Police have not been specific about the relationship between Davis and McNeil, but sources say McNeil once dated Davis' sister.

A body believed to be that of Davis was found Monday near a road in Sanford, which is about 30 miles northwest of Fayetteville. Shaniya had been staying with her mother during the last three weeks of her life.

Police have said they are awaiting positive identification of the body, which has been transported to the state medical examiner's office in Chapel Hill for an autopsy and positive identification.

Last Tuesday, Davis reported Shaniya missing from her home in a mobile home park in Fayetteville, North Carolina. According to police, surveillance video from a hotel in Sanford shows Shaniya being carried to a hotel elevator by McNeill who has been charged with kidnapping.

UPDATE: The Body of Shaniya Davis Has Been Found

The body of Shaniya Davis has been found in Sanford,North Carolina just a few moments ago says Theresa Chance, public information officer of the Fayetteville Police Department. The search recently became focused on land in Sanford after police received reliable information indicating that the child's body had been dumped on land in that city. Investigators had been searching for Shaniya for several days.

Police have charged the girl's mother, Antoinette Nicole Davis, with trafficking and other offenses, authorities said. Davis was "prostituting her child," Chance said.

Searchers found Shaniya's body off a road approximately 45 minutes ago after searching in woods with four-wheelers, water and by air.

Syd Severe, 42, who came down from Raleigh to help in the search, said he doesn't believe in the death penalty but feels the culprits in this case deserve it.

"We were hoping that someone could carry her home," Severe said. "It's just sick."

Shaniya Davis' father, Bradley Lockhart, said he raised his daughter for several years but last month decided to let her stay with her mother after Antoinette Davis had appeared to have gotten her life together.

He was quoted having told an Associated Press reporter "I should have never let her go over there."

UPDATE: 'Reliable Information' Indicates Child is Dead

Acting upon "reliable information," Fayetteville police along with residents are now searching for the body of Shaniya Davis.

The search has become focused on an area in Sanford, North Carolina because the "reliable information" the police received states that the body of Shaniya Davis may have been dumped in that location.


Police have charged Shaniya's mother, Antoinette Nicole Davis, with human trafficking among other offenses. Davis was "prostituting her child," said Fayetteville police spokeswoman Theresa Chance.

The mother told police last week that the child vanished from their mobile home in Fayetteville.

The man caught on a Hotels surveillance video with Shaniya Davis in his arms is Mario Andrette McNeill. He has been charged with first-degree kidnapping and is being held in jail.

SUNDAY, November 15, 2009

• Authorities acting on a tip are scouring a portion of south-central North Carolina for a 5-year-old girl reported missing by her mother. Multiple agencies have been searching for Shaniya Davis since 8 a.m.

• SANFORD, NC (WTVD) -- Fayetteville police confirmed Sunday that they were searching on the ground for a missing 5-year-old girl between Fayetteville and Sanford. Chopper 11 confirms a Fayetville forensics truck is on the scene and officers are searching near Walker Road off Highway 87 in the Sanford area.Witnesses told ABC11 Eyewitness News they saw officers searching a ravine in that area around 10 a.m.

• Sanford is about 40 miles north of Fayetteville. Police did not say if they were looking for a body or if they hoped to find Shaniya Davis alive.

• The father of a missing 5-year-old North Carolina girl says he never should have allowed her to go back to her mother.

UPDATE: Police Searching For Shaniya Davis in Wooded Area of Sanford, NC

Sources say that the search for 5-year-old Shaniya Davis has moved to a remote wooded area of Lee County. At this time Law enforcement and residents are searching the wooded areas and waters along Walker Road in the county (City of Sanford). A road in the county near N.C. 78 has been taped off with yellow crime-scene tape.

By 3 p.m., several all-terrain vehicles were seen around the area and later, a Highway Patrol helicopter was present. Right now, it's beginning to look like this search is turning grim. Shaniya Davis was last seen on videotape in the arms of Andrette McNeil, who is currently in police custody inside of a hotel approximately seven miles south of the scene where investigators are currently searching.


McNeill surrendered to police Friday and was charged with first-degree kidnapping. Police say he admitted to the kidnapping of the child but that he did not know where Shaniya was at the time of his arrest. McNeill's bail has been set at $100,000.

Police say an employee of the hotel on video called police to report that they saw a child matching Shaniya's description. When police arrived McNeill and the child were already gone. Authorities reviewed surveillance video and confirmed the child's identity through family members.

Last night, police arrested Shaniya’s mother, Antoinette Davis, and accused her of felony child abuse involving prostitution, interfering with a police investigation, filing a false police report and human trafficking. The mother is in jail and her bond has been set at $51,000. Arrest documents state that the 25-year-old mother has been "uncooperative" with detectives.

Davis, who is employed as a caregiver Carolina Inn at Village Green, an assisted living facility, reported her daughter missing to police on Tuesday. Her job is located on Forsythe Drive, between Village Drive and Robeson Street. No word from police on whether that area has been searched.

Davis told police that she last saw her child at 5:30 a.m. on a couch in their mobile home. When she went to check on little Shaniya later, she was gone. Davis reported her child's disappearance at 6:53 a.m. The mobile home is located in the Sleepy Hollow Mobile Home Park off Murchison Road in Fayetteville and little Shaniya had only been living with her mother for about three weeks.

Prior to that time, Shaniya lived with her father, Bradley Lockhart also of Fayetteville, for about four years. Lockhart, who described his relationship with the mother as a "one-night stand" to an Associated Press reporter said he let the child live with her mother because Davis had found a place to live and had held a job for six months.

“I just wanted her to be a mother,” he said Saturday. “She was never part of her life.” Lockhart said he and Davis never argued about him raising Shaniya and that he did not know anything about McNeill. Mother of Missing Fayetteville Child Arrested

The mother of 5-year-old Shaniya Davis, who has been missing for several days, has been charged in connection with the child's disappearance.

Antoinette Nicole Davis has been charged by Fayetteville police with human trafficking, felony child abuse, prostitution and filing a false police report.

Police dropped kidnapping charges against another man, Clarence Coe, who was arrested Thursday. The other man charged, Mario Andrette McNeil, is still in police custody, but has divulged no information on Shaniya Davis' whereabouts.

McNeil is the man seen on grainy videotape surveillance holding Shaniya Davis.
Clarence Coe and family members of the child's mother have confirmed that McNeil is the former boyfriend of Antoinette Davis' sister.

McNeil has been charged with first-degree kidnapping.

Shaniya's mother (left) told police that the child simply vanished from a couch in her Fayetteville mobile home on Tuesday around 5:30 a.m.
