On June 11, Scott McGann was in a Manhattan courtroom being arraigned on misdemeanor charges. The judge in that case, James Gibbons, wanted McGann to undergo a psychiatric examination due to his "erratic" behavior during court proceedings.
The judge ordered the "out" psych eval and then freed McGann
without bond. This was seven weeks prior to the fake bomb scare at Laguardia Airport. McGann arrived at that court hearing straight from Bellevue Hospital's psychiatric ward. He had been there for a week for acting erratically during another hearing he had at the courthouse.
"He refused to speak," a law enforcement source said of why McGann was taken to Bellevue after the June 4 arrest.

McGann's mother says that he has catatonic schizophrenia, which leaves him unable to speak.
David Bookstaver, a spokesman for the Office of Court Administration said that McGann was released at that time because "He was not, at the time, a threat to himself or others."
The psychiatric evaluation that Judge Gibbons ordered is known as an "out" psych exam - which basically means that McGann was released from custody but had to report to a psychiatric clinic and have an evaluation done.
"I don't believe it ever got scheduled," said Sean Parmentar, McGann's lawyer.

McGann, a drifter with a history of "deranged behavior," shutdown the Queens hub of Laguardia International Airport on Aug. 1, after he appeared to be trying to detonate what looked like a bomb in his backpack. It turned out to be a fake.
