Bi-Polar Mom Tossed Baby to Hudson Asks Judge to Release Her to Hubby

Devi Silvia, the mother who threw her 19-month-old baby into the Hudson River last month claims she did it just to get back at her husband -- the same man she asked a New York judge to release her to while she awaits trial.

Silvia, an Indian national, made the request Monday while her husband sat in the courtroom galley, teary-eyed, according to the New York Post. Judge Lewis Stone appeared agreeable to Silvia's "set me free" quest stating that he thought Rikers Island seemed "the least appropriate situation," so long as the 33-year-old mother of two could receive outpatient treatment for her newly diagnosed bipolar disorder.

Her husband left the courtroom without commenting.

Silvia has been charged with assault, reckless endangerment and endangering the welfare of a child after witnesses saw her toss her daughter into the Hudson River, then jump in after her. Mother and daughter were spotted Tuesday morning in the River by passers-by who came across an empty stroller on a pier.

Both were transported to a Manhattan hospital, where they were listed in serious condition. When Silvia was released from the hospital, she was taken into custody.

Silvia remains in custody in the psychiatric ward at Elmhurst Hospital.
