Frantic calls to 911 sent New York City police to Public School 194 in Sheepshead Bay where they found themselves face-to-face with the son of George D'Amato Sr., a retired criminal investigator with the New York State Tax Department, who was waving what looked like a real handgun.

Students and parents were mingling in front of the Brooklyn school when they saw George D'Amato, 22, waving a silver-and-black gun. It turns out the gun was a fake, but no one knew that at the time.

As officers arrived on the scene, D'Amato pointed the gun at one of the officers and refused orders to drop it.

One of the responding officers fired three shots killing D'Amato who was taken to Coney Island Hospital where he was pronounced dead sometime after 4 p.m.

Police officials refused comment on the shooting, but other police officials said they were confident the officer, a two-year veteran of the NYPD, acted appropriately. Police had received reports D'Amato had been harassing children near a housing complex and little league field earlier in the day allegedly with the same toy weapon.

Police records show D'Amato had one previous arrest from February 27, 2010 for criminal mischief and possession of burglar's tools charges.
